Terms of Service - Podify AI

These Terms of Service ("Terms") govern your use of the Podify AI mobile application ("App"), developed and operated by Yaysoft LTD. By downloading, installing, or using Podify AI, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Podify AI is an AI-powered content transformation platform that allows users to convert various types of content into different formats. The App provides the following services:

Podcast Generation — Convert web articles, YouTube videos, documents, photos, and text into AI-narrated podcasts with customizable voices and styles.
AI Summaries — Generate condensed summaries of content with adjustable length, style, and focus.
Flashcard Creation — Create study materials in multiple formats (Q&A, fill-in-the-blank, true/false, multiple choice).
Translation — Translate content into supported languages (English, Arabic, Turkish, Spanish, French, German) with configurable style and formality.
Photo OCR — Extract text from images using on-device text recognition.
Community Discover — Browse and discover publicly shared content from other users.

2. Eligibility

You must be at least 13 years of age to use Podify AI. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms. By using the App, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

Podify AI uses anonymous authentication. No email, password, or personal identifiers are required. A unique anonymous user ID is assigned to your device for service operation. You are responsible for maintaining the security of your device and your access to the App.

4. Subscriptions and Payments

4.1 Subscription Plans

Podify AI offers premium subscription plans (weekly and annual) that unlock full access to all features, including unlimited content generations. Free usage may be limited.

4.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. All payments are processed by Apple or Google respectively. Pricing is displayed in the App and may vary by region.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your device's App Store or Play Store settings.

4.4 Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. Yaysoft LTD does not directly process refunds.

4.5 Restore Purchases

If you reinstall the App or switch devices, you can restore your subscription using the "Restore Purchases" option in the App.

5. User Content

5.1 Content You Submit

You may submit URLs, YouTube links, documents (PDF, DOCX, TXT), photos, and plain text to the App for processing. You represent and warrant that:

You have the right to submit the content for processing.
The content does not violate any applicable laws, regulations, or third-party rights.
The content does not contain illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable material.

5.2 Content Storage

Your Control

Your submitted and generated content is stored on our servers with your consent to enable the services you request. You retain full control over your content:

• You may delete any content at any time — whether before or after processing.

• Deleted content is permanently removed from our servers, including all associated files (audio, text, metadata).

• You may choose to make content public (visible in the community discover feed) or keep it private (visible only to you).

• You may change content visibility from public to private at any time.

5.3 License to User Content

By submitting content to Podify AI, you grant us a limited, non-exclusive, worldwide license to process, transform, store, and display your content solely for the purpose of providing the App's services. For content you make public, you additionally grant us the right to display it to other users through the community discover feed. This license terminates when you delete the content.

5.4 AI-Generated Content

Content generated by Podify AI (podcasts, summaries, flashcards, translations) is produced using artificial intelligence. While we strive for accuracy:

AI-generated content may contain errors, inaccuracies, or omissions.
Generated content should not be relied upon as the sole source of information for critical decisions.
We do not guarantee that generated content is free from bias or factual errors.
You are responsible for reviewing and verifying AI-generated content before using it.

6. Copyright and Intellectual Property

Podify AI respects intellectual property rights and expects its users to do the same.

6.1 Your Responsibility

You are solely responsible for ensuring that the content you submit to Podify AI does not infringe upon the copyrights, trademarks, or other intellectual property rights of any third party. Processing copyrighted content without proper authorization is a violation of these Terms.

6.2 Copyright Infringement and Content Removal

If we receive a valid notice that content processed or hosted through Podify AI infringes upon intellectual property rights:

We will promptly remove or disable access to the infringing content.
The content may be removed without prior notice to the user who submitted it.
We will notify the affected user of the removal when feasible.
We may retain records of removed content for legal and compliance purposes.

6.3 Repeat Infringers

We maintain a policy against repeat copyright infringers. Users who repeatedly submit infringing content may have their access to Podify AI suspended or permanently terminated.

6.4 Copyright Complaints

If you believe your copyrighted work has been used through Podify AI without authorization, please send a notice to support@podifyai.app containing:

A description of the copyrighted work you claim has been infringed.
The specific content within Podify AI that you believe infringes your rights.
Your contact information (name, address, email, phone).
A statement that you have a good faith belief that the use is unauthorized.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

6.5 Podify AI's Intellectual Property

The App itself, including its design, code, features, trademarks, and branding, is the intellectual property of Yaysoft LTD. You may not copy, modify, distribute, or reverse-engineer any part of the App.

7. Prohibited Uses

You agree not to use Podify AI to:

Submit content that infringes upon intellectual property rights of others.
Process, generate, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Distribute hate speech, violent content, or content that promotes discrimination.
Impersonate any person or entity, or misrepresent your affiliation.
Attempt to gain unauthorized access to our systems, servers, or other users' accounts.
Use the App for any commercial purpose without our prior written consent, including reselling generated content as a service.
Use automated scripts, bots, or scrapers to interact with the App.
Interfere with or disrupt the App's functionality or infrastructure.
Circumvent or attempt to circumvent subscription requirements or usage limits.
Use the App to generate spam, misleading content, or disinformation.

8. Content Moderation and Reporting

8.1 Community Standards

Content shared publicly through the community discover feed must comply with these Terms. We reserve the right to review and remove any public content that violates these Terms or that we determine to be inappropriate.

8.2 Reporting

Users can report content they believe violates these Terms or applicable laws through the in-app reporting feature. We review all reports and take appropriate action, which may include:

Removing the reported content from public view or from our servers entirely.
Warning the user who posted the content.
Suspending or terminating the account of the user who posted the content.

8.3 Content Removal by Podify AI

We reserve the right to remove any content, at any time, for any reason, including but not limited to:

Copyright or intellectual property infringement.
Violation of these Terms or applicable laws.
Content reported by other users and confirmed to be in violation.
Content deemed harmful, inappropriate, or objectionable.
Operational, legal, or regulatory requirements.

9. Disclaimers

9.1 "As Is" Service

Podify AI is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9.2 AI Limitations

Podify AI uses artificial intelligence to process and generate content. AI-generated outputs may be inaccurate, incomplete, or biased. We do not guarantee the quality, accuracy, or reliability of any AI-generated content. You use such content at your own risk.

9.3 Third-Party Content

Podify AI processes content from third-party sources (websites, YouTube, etc.). We are not responsible for the accuracy, legality, or appropriateness of third-party content. We do not endorse any third-party content processed through the App.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Yaysoft LTD and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Podify AI, including but not limited to:

Loss of data or content.
Errors or inaccuracies in AI-generated content.
Unauthorized access to or alteration of your data.
Service interruptions or downtime.
Any third-party claims related to content you submitted or generated.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Yaysoft LTD, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

Your use of the App.
Content you submit or generate through the App.
Your violation of these Terms.
Your violation of any third-party rights, including intellectual property rights.

12. Termination

12.1 By You

You may stop using Podify AI at any time. To cancel a subscription, manage it through your device's App Store or Play Store settings.

12.2 By Us

We reserve the right to suspend or terminate your access to Podify AI at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms.
Repeated copyright infringement.
Submission of prohibited content.
Abusive or fraudulent use of the App.

12.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. We may delete your content and data following termination. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) shall survive.

13. Changes to These Terms

We may modify these Terms at any time. Updated Terms will be posted within the App and the "Last Updated" date will be revised. Your continued use of Podify AI after changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Yaysoft LTD operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the competent courts of that jurisdiction.

15. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Yaysoft LTD regarding your use of Podify AI.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without your consent.
